This video contains my top three DUI tips to keep in mind if you are suspected of driving under the influence.
Number one – do not answer any questions! You have a right to remain silent, and to not answer questions without a lawyer present. If the officer asks you questions like “have you been drinking”, or “did you know you smell like alcohol”, politely tell them that you do not answer questions without a lawyer present.
Number two – do not take field sobriety tests! It is completely legal to decline to take these tests, and you should not engage in “roadside olympics”, as I like to call them. Again, politely decline to take the tests.
Number three – if requested, take the roadside breath test and the breath test for blood-alcohol at the police station, but after you take the test, request a blood test. By law the police have to give this to you, and it may be more accurate than the breath tests that you have already taken.
And even though this is not in the top three, most importantly, don’t get behind the wheel if you are impaired! Call a friend, get an Uber or call a taxi – it’s the most responsible thing to do.
