A Manhattan Supreme Court Justice recently ruled that the NYPD must release maintenance records for 28 Breathalyzer machines, stating that the accused have the right to examine the maintenance data for the machines. (These machines test a person’s breath for blood-alcohol content, (B.A.C.) and are often the government’s strongest piece of evidence in a DUI case.)

Courts across the country are now starting to provide people who are accused of DUI with the maintenance and calibration data from their breath testing machines.
